I am sitting at my office Monday morning checking my mailbox and trying to think of something creative to do.

This municipality I live in is truly unique for many reasons. Aside from a booming economy Mexico has a most interesting history to do with control over its Real Estate.

I attended a seminar recently, held by Stewart Title Guaranty. This company is from Galveston Texas and has been insuring titles since 1893. We were given an overview of Mexico’s tumultuous History regarding control over this countries real estate. We were told that after 4,000 years Mexico is in control, but not before being ruled by the Spain, France, Quebec, and the United States. In 1848, a land purchase of Texas, Nevada, Arizona, New Mexico, Utah, ½ of California, and ¾ of Colorado was made by the United States from Mexico. The cost was $15,000,000.00 and a forgiven debt of $3,200,000.00. This represented half of Mexico’s land mass and now represents 1/3 of the entire United States.

In 1910 the Constitution was written which there was a revolution by the people claiming the land had been unfairly distributed amongst the people of Mexico. In 1917 there was the reform of the Constitution granting the Ejido (Mexican Ranchers) user rights to the property. An amendment was made 1992 allowing the Ejido to Privatize the property with a vote of 70%. This allowed the Ejidotario’s the opportunity to release it from the Secretaria Agrarian designation, or Agricultural Land Reserve and sell it. In 1971 the original 30 year fideicomiso was introduced to give foreigners an opportunity to own property within the restricted zone (30 miles from the coastline, 60 miles from all borders). In 1989 another amendment was made to allow the 30 year fideicomiso to be renewed. In 1993 with the introduction of N.A.F.T.A. the trust was extended to 50 years. I think you can appreciate why this location is such a hot spot.

This booming resort economy has only been opened up to foreign investment for the past 13 years making this the newest, and perhaps the final frontier in North American.
